4.1 AI Workflow Builder Terms
Usage Rights
Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to use the AI Workflow Builder for your internal business purposes.
Workflow Ownership
- You retain all rights to workflows you create
- You own all data processed through your workflows
- We may use anonymized workflow patterns to improve our AI models
- Shared templates become available under Creative Commons license
Usage Limits
Your subscription plan includes specific limits on:
- Number of active workflows
- Monthly execution quota
- API calls per minute
- Data storage capacity
- Integration connections
Exceeding these limits may result in additional charges or service throttling. Contact us for enterprise plans with custom limits.
Acceptable Use
You agree not to use the AI Workflow Builder to:

- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Create spam or malicious automation
- Overload or disrupt our infrastructure
- Reverse engineer or attempt to extract our AI models
4.2 Identity Service Terms
Service Scope
Our Identity Service provides authentication and authorization capabilities. You are responsible for:

- Responding to security incidents
- Compliance with applicable regulations (GDPR, CCPA, etc.)
Security Responsibilities
Our Responsibilities:
- Maintain secure infrastructure and encryption
- Provide security updates and patches
- Monitor for suspicious activity
- Notify you of security incidents
- Implement industry-standard security practices
Your Responsibilities:
- Configure secure authentication policies
- Enforce strong password requirements
- Enable and require MFA where appropriate
- Regularly review access logs
- Promptly revoke access for terminated users
- Report security vulnerabilities
Data Processing
Identity Service processes the following data:
- Authentication Data: Usernames, hashed passwords, MFA tokens
- User Attributes: Email, name, profile information
- Session Data: Tokens, device information, IP addresses
- Audit Logs: Login attempts, permission changes, access events
We act as a data processor on your behalf. You are the data controller and must ensure compliance with data protection regulations.
4.3 AI Model Training
To improve our AI products, we may use aggregated and anonymized data. We will never:
- Use your specific business data to train models available to other customers
- Share your proprietary workflows or configurations
- Expose your sensitive information in model outputs
- Use personal information for training without consent
Enterprise customers can opt-out of contributing to model training. Contact us for dedicated AI models trained exclusively on your data.
5. Payment Terms
5.1 Fees and Billing
Fees for our Services are as described on our website or in your service agreement. You agree to:
- Pay all fees on time according to the billing schedule
- Provide valid payment information
- Pay any applicable taxes
- Notify us of any billing disputes within 30 days
5.2 Subscription Plans
Monthly Subscriptions
- Billed monthly in advance
- Auto-renewal unless cancelled 7 days before renewal
- Prorated adjustments for plan changes
Annual Subscriptions
- Billed annually in advance (typically 15-20% discount)
- Auto-renewal unless cancelled 30 days before renewal
- No refunds for mid-term cancellations
Enterprise Plans
- Custom pricing based on requirements
- Flexible billing terms
- Dedicated support and account management
- Service level agreements (SLAs)
5.3 Price Changes
We may change our pricing with 30 days' notice. Price changes will not affect your current billing period but will apply upon renewal.
5.4 Late Payments
Late payments may result in:
- Service suspension after 10 days
- Account termination after 30 days
- Late fees of 1.5% per month (or maximum allowed by law)
- Recovery costs if legal action is required
5.5 Refund Policy
Custom Development Projects: 50% deposit required, non-refundable after work begins. Balance refundable only if we fail to deliver agreed milestones.
Subscription Services: 14-day money-back guarantee for new subscriptions. No refunds after 14 days or for renewals.
One-Time Services: Refunds evaluated case-by-case based on delivery and satisfaction.
6. Intellectual Property Rights
6.1 Our Intellectual Property
The Services and all content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by DreamyHook Digital Media and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content
You retain all rights to content, data, and materials you submit or upload to our Services ("Your Content"). By using our Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, and process Your Content solely to provide the Services.
6.3 Work Product
For custom development projects:
- Upon Full Payment: You receive full ownership of custom code, designs, and deliverables created specifically for you
- Our Frameworks & Tools: We retain rights to our proprietary frameworks, libraries, and reusable components
- Third-Party Components: Subject to their respective licenses (we will disclose all third-party dependencies)
- Portfolio Rights: We may showcase the work in our portfolio unless otherwise agreed
6.4 Trademarks
DreamyHook, the DreamyHook logo, and other marks are trademarks of DreamyHook Digital Media. You may not use our trademarks without prior written permission.
7. User Responsibilities
7.1 Prohibited Activities
You agree not to:
- Use the Services for any illegal purpose or in violation of any laws
- Infringe upon the intellectual property rights of others
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems
- Scrape, crawl, or data mine our Services without permission
- Impersonate others or provide false information
- Harass, abuse, or harm other users
- Interfere with the proper functioning of the Services
- Resell or redistribute our Services without authorization
7.2 Compliance
You are responsible for ensuring your use of the Services complies with all applicable laws and regulations, including but not limited to:
- Data protection and privacy laws (GDPR, CCPA, DPDPA)
- Export control regulations
- Industry-specific regulations (HIPAA, PCI-DSS, etc.)
- Intellectual property laws
- Anti-spam and communications laws

8. Service Level Agreement (SLA)
8.1 Uptime Guarantee
For subscription services, we commit to the following uptime guarantees:
Standard Plans
- Uptime Target: 99.5% monthly uptime
- Support Response: Within 24 business hours
- Maintenance Windows: Scheduled during off-peak hours
Professional Plans
- Uptime Target: 99.9% monthly uptime
- Support Response: Within 8 business hours
- Priority Support: Email and chat support
Enterprise Plans
- Uptime Target: 99.95% monthly uptime
- Support Response: Within 2 hours (critical), 4 hours (high)
- 24/7 Support: Phone, email, and chat
- Dedicated Account Manager: Proactive monitoring
- Custom SLA: Negotiable terms
8.2 Planned Maintenance
We will provide at least 72 hours' notice for planned maintenance that may affect service availability. Emergency maintenance may be performed with less notice.
8.3 Service Credits
If we fail to meet our uptime commitments, you may be eligible for service credits:
- 99.0-99.49% uptime: 10% monthly fee credit
- 98.0-98.99% uptime: 25% monthly fee credit
- Below 98.0% uptime: 50% monthly fee credit
Service credits must be requested within 30 days of the incident. Credits are your sole remedy for service availability issues.
9. Limitation of Liability

9.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Services will be uninterrupted, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- The quality of any products, services, or information obtained through the Services will meet your expectations
- Any errors in the Services will be corrected
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DREAMYHOOK DIGITAL MEDIA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ₹10,000 (WHICHEVER IS GREATER).
9.3 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
9.4 Indemnification
You agree to indemnify, defend, and hold harmless DreamyHook Digital Media and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of any rights of another party
- Your use of the Services
- Your content or data
10. Termination
10.1 Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through your account settings

Upon termination:
- You will continue to have access until the end of your current billing period
- No refunds will be issued for the remaining subscription period
- Your data will be retained for 30 days for recovery purposes, then permanently deleted
10.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice or liability, if:
- You breach these Terms
- We are required to do so by law
- Your use of the Services poses a security risk
- You engage in fraudulent activity
- Your payment fails repeatedly
10.3 Effect of Termination
Upon termination of your account:
- Your right to use the Services will immediately cease
- We may delete your account and all associated data
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability
10.4 Data Export
Before termination, you may export your data using our data export tools. We are not responsible for data loss after account termination.
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
11.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.
11.3 Dispute Resolution Process
Step 1: Informal Resolution
Before filing a formal claim, you agree to contact us at hello@dreamyhook.in to attempt to resolve the dispute informally. We will work in good faith to resolve the matter within 30 days.
Step 2: Mediation
If informal resolution fails, both parties agree to attempt mediation before pursuing litigation. Mediation will be conducted by a mutually agreed-upon mediator in Gurugram, Haryana.
Step 3: Arbitration
If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Gurugram, Haryana, in English.
11.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
- Sending an email notification to your registered email address
- Displaying a prominent notice in the Services
Your continued use of the Services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and may terminate your account.
Material Changes
For material changes that may adversely affect your rights, we will provide at least 30 days' notice before the changes take effect. You may terminate your account within this notice period if you do not agree to the changes.
13. General Provisions

These Terms constitute the entire agreement between you and DreamyHook Digital Media regarding the Services and supersede all prior agreements and understandings.
13.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
13.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
13.5 Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Our Services may contain links to or integrate with third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms and conditions.
